So, let's get started . . .
Stay Out of Trouble!!
The incidence of patient complaints seems to be rising within the past few years and many dentists are being reprimanded for not providing proper informed consent.
"Informed consent is a legal condition whereby a person can be said to have given consent based upon an appreciation and understanding of the facts and implications of an action."
The standard for obtaining informed consent used to be defined as what a reasonable practitioner would disclose, but this standard was redefined in 1980 (in Canada). The new standard now used as a guideline is what a reasonable person would need to know in order to make an informed consent.
There are key elements that need to be communicated to the patient in order to obtain proper informed consent:
It is your responsibility to ensure that your patient understands the treatment recommendations and that they feel they have been fully involved in the decision making process. Even something that you might take for granted, such as what type of crown you are fabricating (eg: PFM or All-Ceramic) should involve the patient. If you make the decision yourself, it might come back to bite you!!
And of course, don't forget to document in your patient chart that you have provided proper informed consent!!
(Reference: RCDSO dispatch summer 2006. The guidelines for informed consent can vary from one jurisdiction to another. Check with your licensing body or get legal advice to obtain the guidelines for your area.)
How does all this affect me . . . you ask?
If you haven't yet jumped on the Implant bandwagon, and are not doing Implants in your own practice, you still need to offer this option to your patients. Implant therapy now falls within the standard of care for the replacement of missing teeth and is a viable treatment option which the patient needs to be informed about.
Where's Waldo? . . . Ooopps, I mean Dr. Hebel?
Dr. Hebel is still lecturing all over the place every week (check out his hectic schedule), doing mini-residency programs in London, Dallas, California and New Jersey and in addition, he is now teaching implant dentistry at the University of Western Ontario!!
